PUBLIC OFFER AGREEMENT

The following text is a contract between the online store www.sakwoyag.com.ua (hereinafter referred to as the “Seller”) and the user of the online store services, hereinafter referred to as the “Buyer,” and sets out the terms of sale of goods to the Buyer via the Seller's website. This agreement is a public offer, equivalent to an "oral agreement" and, in accordance with the current legislation of Ukraine, has full legal force.

GENERAL PROVISIONS

1.1. This agreement is a public offer agreement (according to Articles 633, 641 of the Civil Code of Ukraine), and its terms are the same for all buyers regardless of their status (individual, legal entity, sole proprietorship).

1.2. By accepting the terms of this agreement—the Seller's public offer—the user becomes a Buyer.

1.3. According to Article 642 of the Civil Code of Ukraine, full and unconditional acceptance of this offer (public offer), which confirms the conclusion of a sales contract on the proposed terms, is the Buyer’s act of paying for the ordered Product on the Website (or by another method).

TERMS AND DEFINITIONS

2.1. Online Store – a Seller’s website created for concluding retail and wholesale sales agreements based on the Buyer’s familiarization with the offered Product descriptions via photographs, using the Internet, which excludes direct familiarization with the Product—thus qualifying as a remote sale.

2.2. Product – the list of goods published on the Online Store’s website, including models, accessories, components, and related items offered for sale or already purchased by the Buyer from the Seller by remote method.

2.3. Buyer – a natural person aged 18+, receiving information from the Online Store, placing an order to search, assemble, and reserve Products listed on the Online Store website for purposes unrelated to business activities, or a legal entity / sole proprietor.

2.4. Order – a completed and submitted request by the Buyer to the Seller for the selection, reservation, and further purchase of the Product.

2.5. Website – a set of web pages and software modules managed under a unified system, located at www.sakwoyag.com.ua, and containing all features of a public offer for the selection, reservation, and ordering of Products chosen by the Buyer.

2.6. Personal Account – a private space on the Website accessible to the Buyer that displays personal information and order history.

SUBJECT OF THE AGREEMENT

3.1. This agreement defines the procedure of interaction and service provision by the Seller to the Buyer, based on the Buyer’s intention and ability to use services for Product selection and reservation, and the Seller’s desire to provide relevant information and reserve the ordered Products.

3.2. The Seller provides the following services:

3.2.1. Selection, reservation, and sale of Products based on the Buyer’s order submitted through the Website and confirmed by the Seller.

3.3. The Seller sells and delivers Products via courier delivery services listed on the Website based on orders placed and confirmed. Prices include the cost of selection and reservation services unless otherwise stated. Delivery is paid separately by the Buyer to the courier service.

3.4. The Buyer agrees to the terms of this agreement by clicking the “Confirm Order” button when submitting an order. This confirms the Buyer’s acceptance of and agreement with the terms. Any denial of such agreement voids the Seller’s liability and gives the Seller the right to cancel the order.

WEBSITE USAGE RULES

4.1. The Buyer may view content, place orders, and use other services.

4.2. Registration is required for personalized access and extended features.

4.3. During registration, the Buyer provides:

  • Username

  • Email address

  • Phone number

  • Password

4.4. The Buyer must provide accurate and complete information. The Seller is not responsible for inaccuracies.

4.5. After registration, the Buyer gains access to the Personal Account.

4.6. The Buyer agrees not to disclose login details. In case of unauthorized access, the Buyer must immediately inform the Seller at sakwoyag@gmail.com or +380688690115.

4.7. The Buyer is responsible for all actions performed under their account.

4.8. The Seller may refuse service in case of false data or bad conduct.

4.9. The Website may not be used for illegal activities. Buyers agree to follow Ukrainian law and online norms (e.g., no extremist or offensive materials).

ORDER PROCEDURE

5.1. The Buyer places orders by adding Products to the cart and clicking “Place Order.”

5.2. Orders can be placed by registered and unregistered users.

PAYMENT TERMS

6.1. The Buyer pays for the ordered Products and Seller’s services as per the confirmed order:

  • In advance via bank account

  • Upon delivery by the courier service

6.2. The total order cost is displayed during checkout and includes the full Product and service costs.

RETURN POLICY

7.1. The Buyer may return defective goods within 14 days if the original packaging, condition, and properties are preserved.

7.2. If the Buyer refuses the parcel, it is returned to the Seller at the Buyer’s expense.

PRIVACY AND PERSONAL DATA PROTECTION

8.1. During registration, the Buyer provides personal information.

8.2. By registering or placing an order, the Buyer consents to data processing in accordance with the Law of Ukraine "On Personal Data Protection."

8.3. The Seller uses personal data to provide services and promote offers, including via automated processing.

8.4. The Seller will not disclose Buyer data except to agents or third parties under contract or as required by law.

8.5. To revoke data processing consent, the Buyer must contact support, which terminates service use.

8.6. The Buyer must keep personal data up to date. The Seller is not liable for outdated information.

INFORMATION MESSAGES

9.1. By registering, the Buyer consents to receive promotional and informational messages via SMS and email.

9.2. The Buyer can opt out via settings in the Personal Account.

USE OF SITE MATERIALS

10.1. The site contains copyrighted materials including texts, images, trademarks, etc.

10.2. All content is protected by Ukrainian law.

10.3. The Buyer may not alter, publish, sell, or redistribute materials without permission.

OTHER CONDITIONS

11.1. This agreement is governed by Ukrainian law.

11.2. Invalidity of any clause does not invalidate the entire agreement.

11.3. Disputes are resolved through negotiation. If unresolved, disputes are handled in Ukrainian courts.

11.4. The Seller may update the agreement at any time. The current version is always available on the Website.
